Welcome to Kaya AI. These Terms of Use ("Terms") govern access to and use of our artificial intelligence SaaS platform. By registering and using our services, the user ("Client") agrees to be bound by these conditions.
1. Service Description
Kaya AI is a platform that enables the creation, training, and integration of automated virtual assistants powered by Artificial Intelligence across multiple channels, including WhatsApp and web widgets, using customized knowledge bases provided by the Client.
2. Prohibited Uses
The user expressly agrees not to engage in the following practices while using Kaya AI:
- Spam and Abuse: Using the platform for bulk unsolicited marketing messages, actively breaking WhatsApp and other operators anti-spam policies.
- Illegal Activities: Promoting, organizing, or sharing illegal, defamatory, fraudulent, obscene, violent, or hate-promoting content.
- System Manipulation: Attempting to bypass technical limits, reverse engineer, jailbreak language models, or extract server infrastructure without authorization.
- Identity Misrepresentation: Making your AI agent impersonate a human for malicious deception such as phishing or improper data collection.
3. AI Training and Data Ownership
The Client acknowledges sole responsibility for all documentation, URLs, or files uploaded to the agent knowledge base. The Client guarantees they hold the legal permissions and copyright for the content used to train the bot. Kaya AI does not claim intellectual property over private files and uses them only to contextualize responses.
4. Account Suspension and Termination
The security and integrity of integrations depend heavily on legitimate use. Kaya AI reserves the right to immediately suspend, deactivate, or delete any account or workspace when suspicious activity is detected, especially if it violates section 2, risks phone-number bans, or generates continued complaints from end users.
5. AI Reliability Limitation
Due to the probabilistic nature of LLMs, outputs generated by agents may in isolated cases be incorrect or unreliable. The user acknowledges this inherent technological limit and accepts that Kaya AI is not commercially or civilly liable for false responses generated by the agent.
6. Payments and Plans
The message limit applicable to the account is updated according to payments for the selected plan. Failure to renew balance in time temporarily suspends the bot activity across associated channels.
7. Terms Updates
Kaya AI may change this page at any time. Continuing to use the widget or agents constitutes the client legal consent to the updated contractual provisions.
